Should developers be open to class action lawsuits for releasing broken products?

When a developer releases a game on consoles that are already out prior to release and the game requires weeks (or longer) of "fixes" to become playable without crashing the equipment,should the developer be open to a lawsuit for breach of contract? The License when we purchase a game is a contract,they should have to meet requirements also.(like playability)

    • Yes! I shouldn't have to pay to be a beta tester.

    • Depends. If it's releasing on a half dozen different platforms @ once I can understand a glitch or two as long as they're fixed within 24hrs of being reported.

    • NO! They're working to bring a game to mutiple platforms and don't have time to test them all before launch.

Ubisoft has once again released a broken game that disappointed people when they tried to play it upon release. Not only does the game randomly crash,but some systems are being made to over heat and the whole system crashes.? Add to that insult the fact that the pre-order goodies won't be released until the new consoles are released and it's just an added slap in the face to people who pre-ordered. Notice that TU2.0 for XBOX is STILL delayed??? lol, That was the console with the most problems with the game.
